Please read these Terms and Conditions carefully before using our services.
1. Definition of terms:
The terms "us", "we", and "our" mean The Traditional Cob Registry (TCR).
2. Acceptance of Terms and Conditions:
Your agreement with these Terms and Conditions is a legally binding contract between you and us. If you do not agree with these Terms and Conditions, you will not be able to use our services.
3. Use of Services:
To use our services, you must be 18 years of age or over.
3.1. TCR Registration
If you are the owner (applicant) named on our TCR registration application, then when registering your animal with us, you must accept: -
(a) That you are fully responsible for any information and images provided by you on the application.
(b) That we can refuse to accept your animal for registration if we are not satisfied that it is suitable for registration in a Purebred Traditional Cob or Partbred Traditional Cob register.
(c) That because we do not issue equine identification documents (passports), if your animal is in the EU or UK, it must have a passport (a basic ID passport or a studbook passport) before it can be registered with us.
3.2. TCR Breeder Registration
Before you register as a breeder with us, you must register your breeder prefix with us. If you do register as a breeder with us, then you must accept that your breeder (personal) details can be searched online under ‘Breeders’ on our website.
3.3. TCR Prefix Registration
Before you register a breeder prefix with us, you are responsible for carrying out the checks necessary to ensure that the prefix has not already been registered somewhere else, by someone else. For this reason, if you do register a breeder prefix with us and someone disputes your registration of the prefix with us, then the dispute would be between you and the person disputing your registration of the prefix with us. However, if the person disputing your registration of the prefix with us provides us with a legal letter giving grounds as to why we would be obliged to remove the prefix from our breeder prefix register, and you do not provide us with a legal letter opposing those grounds, we may, unfortunately, be obliged to remove the prefix from our breeder prefix register. However, if we were legally obliged to remove the prefix from our breeder prefix register, we would provide you with an option to register a different breeder prefix with us.
3.4. TCR Stallion Directory
If you are the owner of a TCR-registered stallion, and you add your stallion as a listing on our stallion directory, then you must accept that you are responsible for any information, images and/or videos shown for your stallion on our stallion directory.
4. Service User Account (TCR account holder):
4.1. Sign Up:
To use any of our services, you will need to sign up on our website www.traditionalcobregistry.com as a TCR account holder. You will not be able to sign up as a TCR account holder unless you agree to these Terms and Conditions. You must provide accurate and complete information during the sign-up process.
4.2. Access:
If you sign up on our website as a TCR account holder, you will be granted a limited, non-transferable, and revocable license to access and use our services.
4.3. Security:
If you sign up on our website as a TCR account holder, you will be responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4.4. Prohibited Activities:
By signing up on our website as a TCR account holder, you agree not to engage in any unlawful, abusive, or disruptive behaviour while using your account or our services. This includes but is not limited to, violating any applicable laws, infringing upon intellectual property rights, or distributing harmful content.
4.5. Privacy Policy:
You will not be able to sign up on our website as a TCR account holder unless you agree to our Privacy Policy. Once you have signed up as a TCR account holder, your personal information can, therefore, be protected under our Privacy Policy.
5. Cookies and Tracking:
We use basic cookies to facilitate the sign-in (login) process and may utilise Google Analytics and Hotjar to track user behaviour for analytical purposes. Please refer to our Privacy Policy for more information on how we handle cookies and user tracking.
6. Intellectual Property:
(a) Ownership:
All content, trademarks, logos, and intellectual property displayed on our website are our property and are protected by applicable intellectual property laws.
(b) Use of Content:
No person can modify, reproduce, distribute, or exploit any content displayed on our website without prior written consent from us.
7. Limitation of Liability:
(a) Disclaimer:
All of our services are provided on an "as is" and "as available" basis without any warranties, expressed or implied, and we do not guarantee the accuracy, reliability, or availability of any information on our website.
(b) Use of Content:
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of a person's use or inability to use our website or services.
8. Changes to Terms:
We reserve the right to modify or replace these Terms at any time. All TCR account holders are responsible for reviewing these Terms and Conditions periodically for any changes. Continued use of our services by TCR account holders after changes to these Terms and Conditions are posted constitutes acceptance by the TCR account holders of our revised Terms and Conditions.
